Should I fire my lawyer?

That's weird that you paid a retainer. I could see paying an initial consultation fee but probate lawyers usually don't get paid until the estate is finalized and they get a portion of your cut of the estate distribution. If you don't like him fire him but I should also warn you that good lawyers are often times busy. If he has a great deal of probate law knowledge it might be worth keeping him on but that's completely up to you. If you do fire him and he has already started working on your case, you will have to pay him for the time he has spent already though. Also, probate law has many lengthy waiting periods so there is usually a lot of waiting around and stuff. It's not as fast paced as other areas of law. An estate from filing the petition until finalization takes about a year if there is nobody contesting it, etc. What kind of law does he specialize in? Have you looked at any other lawyers that specialize in that area? Good luck and I'm sorry for your loss.
